1) Eligibility (17+)
The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old and that you have the legal capacity to enter into these Terms.
2) About Tracy
Tracy is an AI-powered platform for creating virtual personas and engaging in immersive chat simulations. You can design characters, interact in dynamic conversations, and explore storytelling, entertainment, or conversational practice experiences.
3) Accounts
- Registration: you may need an account for certain features and agree to provide accurate information (including name/username/email where required).
- Security: you are responsible for keeping credentials confidential and for activity under your account.
- Termination: you may request deletion by emailing fernandomortara562@outlook.com. We may suspend or terminate access if you violate these Terms or to comply with law / protect users and the Service.
4) User Content and AI Features
“User Content” includes any content you submit, upload, transmit, or store through the Service (e.g., text prompts, images, persona details, and messages). You retain rights you have in your User Content, subject to the license below.
- AI-generated output: the Service may generate content based on your inputs. Output may be inaccurate or inappropriate; you are responsible for how you use it and should not treat it as professional advice.
- License to operate the Service: you grant Tracy Team a limited, non-exclusive, worldwide license to host, store, reproduce, process, and transmit User Content solely to operate and secure the Service, provide AI processing you request, and comply with law/enforce these Terms.
- AI processing on our servers: when you choose to upload text/images for AI features, processing occurs on Tracy Team’s own servers. We do not share your uploaded text/images with third parties for processing. Uploads are deleted promptly after processing unless you choose to save resulting content in the Service.
- Photos and face-related use: we do not perform facial recognition and do not create biometric identifiers. Photos/images used for one-time generation are deleted promptly after processing and are not used for training or marketing.
5) Acceptable Use
You agree not to:
- Use the Service in a way that violates applicable law or regulation.
- Infringe or violate the rights of others (including IP and privacy).
- Upload or generate unlawful content, or content involving sexual exploitation of minors.
- Bypass security, probe vulnerabilities, or interfere with the Service’s operation.
- Create or distribute malware, spam, or abusive activity.
- Reverse engineer or attempt to extract source code except where prohibited by law.
6) Privacy
Our collection and use of personal information is described in our Privacy Policy. Additional notices and choices may be presented within the App where applicable.
7) Intellectual Property
- Our IP: the Service and its content (software, design, text, graphics, trademarks) are owned by or licensed to Tracy Team and protected by law.
- Limited license to you: subject to these Terms, we grant you a personal, non-transferable, non-exclusive, revocable, limited license to access and use the Service for lawful purposes.
8) Feedback
If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation to improve the Service.
9) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” To the maximum extent permitted by law, Tracy Team disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10) Limitation of Liability
To the maximum extent permitted by law, Tracy Team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.
To the maximum extent permitted by law, Tracy Team’s total liability for any claim arising out of or relating to the Service or these Terms will not exceed the amount you paid (if any) to use the Service in the 12 months before the event giving rise to the claim.
11) Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Tracy Team from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.
12) Changes to the Service or Terms
We may update the Service and these Terms from time to time. If we make material changes, we may provide notice within the App or otherwise as required by law. Continued use after changes become effective means you accept the updated Terms.
13) Governing Law; Binding Arbitration
To the extent permitted by law, these Terms are governed by the laws of the jurisdiction where Tracy Team is primarily established, without regard to conflict of laws principles.
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration. The seat of arbitration will be Tracy Team’s principal place of business, and the arbitration will be conducted in English. You and Tracy Team agree to attempt to resolve disputes informally before initiating arbitration by contacting the other party and allowing a reasonable period to respond.
